ANY PERSON WHO DOES NOT ACCEPT THESE TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE SITE AND/OR THE SERVICES.
THESE TERMS AND CONDITIONS DO NOT CREATE A PARTNERSHIP, FRANCHISE, JOINT VENTURE, AGENCY, OR EMPLOYMENT RELATIONSHIP BETWEEN THE PARTIES.
- GENERAL PROVISIONS
This document (hereinafter referred to as the “AGREEMENT”) constitutes a contract between the User (hereinafter the “USER”, “USERS”, “PLAYER”, “PLAYERS”) and PIUPIX INC. (hereinafter “ACERTYJO” or “WE”), which governs access to and use of the website www.acertyjo.com (hereinafter, the “PLATFORM”), as well as any products, content, or services offered through it.
1.1 DEFINITIONS
REF (Reference / Referral): means that a User has been registered on the Platform because of a direct recommendation made by another User.
For clarity purposes, the term “Referrals” may be used within the Platform’s dashboard, reports, or user interface modules solely as a label to display recommended Users. Such use does not imply the existence of any hierarchical relationship, network, multi-level structure, employment relationship, partnership, investment, or any economic right other than those expressly established and approved under ACERTYJO’s current Referral Program conditions.
- NATURE OF THE SERVICES
ACERTYJO provides a digital entertainment and mental training platform based on games of logic, reasoning, and skill.
The games available on the Platform do not constitute gambling activities, betting, raffles, prize draws, or casino games, and do not offer cash prizes. Any benefit derived from gameplay consists solely of membership access extensions or other internal benefits defined by the game dynamics.
Use of the Platform does not constitute an investment, financial advice, or a promise of income generation.
Separately, ACERTYJO may offer a Referral Program, which may include monetary compensation in real currency for effective referrals of the Platform. Such compensation is not guaranteed, does not constitute an investment, employment, or labor relationship, and is subject to specific conditions, verification, validation, compliance with applicable policies, and as set forth in ACERTYJO’s applicable legal documents, including, where applicable, the Referral Program policies, the Refund Policy, and anti-fraud policies.
- CONTENT
The services offered by ACERTYJO must be used exclusively for lawful purposes. Any use of the Platform that violates any local, state, national, or international law is strictly prohibited.
- SERVICE DENIAL OR DISCONTINUATION
ACERTYJO reserves the right to suspend or cancel services when the User engages in fraudulent practices, system abuse, or uses automated tools, bots, scripts, or any mechanism that provides unfair advantages.
ACERTYJO may interrupt service without prior notice in cases of maintenance, technical failure, or force majeure.
- CONFIDENTIALITY AND DATA PROTECTION
ACERTYJO undertakes to protect the personal information provided by the User.
The processing of personal data shall be governed by the Privacy Policy published on the Platform, which forms an integral part of these Terms and Conditions.
- LEGAL CAPACITY AND RESPONSIBILITY
Services are available only to persons with legal capacity to contract. The User represents that they are at least 18 years of age.
The User is financially and legally responsible for all use of their account, including unauthorized access by third parties.
- REGISTRATION AND ACCOUNTS
The User must complete the registration form with true, accurate, and up-to-date information.
ACERTYJO may suspend accounts whose data cannot be verified.
The account is personal, unique, and non-transferable.
- SANCTIONS AND ACCOUNT SUSPENSION
ACERTYJO may warn, suspend, or terminate User accounts that violate these Terms and Conditions, the Game Rules, the Referral Program, or any other applicable policy, as well as in cases of fraud, system abuse, use of automation, bots, scripts, or any conduct that provides unfair advantages.
Account suspension or termination shall not entitle the User to any refund, compensation, or indemnification, including access to the Platform, except with respect to amounts that have been previously approved in accordance with the conditions of the Referral Program, and always subject to verification, validation, fraud prevention processes, refunds, chargebacks, breach of these Terms, or any applicable policy.
ACERTYJO reserves the right to withhold, cancel, or reverse any pending amounts or amounts displayed in the User’s dashboard when there are reasonable indications of fraud, abuse, system error, chargebacks, breach of these Terms, or applicable law, without creating any automatic right to claim or compensation.
- SERVICE PROVISION
ACERTYJO may modify or cancel Platform features without creating any right to compensation.
Continuous operation is not guaranteed due to technical reasons beyond ACERTYJO’s control.
- USER OBLIGATIONS
The User agrees to:
- comply with all applicable laws;
• not submit obscene, illegal, or defamatory content;
• not use false identities;
• not deceive, defraud, or mislead other users;
• not use automation tools, bots, or manipulation software;
• not attack security systems or attempt unauthorized access;
• not distribute viruses or malware;
• not use the Platform to offer investments, guaranteed income, financial schemes, or deceptive promises;
• know and comply with the Game Rules.
ACERTYJO may monitor use of the Platform.
- OWNERSHIP RIGHTS
All content is the property of ACERTYJO or third parties.
Any commercial exploitation without written authorization is strictly prohibited.
- INDEMNIFICATION
The User agrees to hold ACERTYJO harmless from claims arising from improper use of the Platform.
ACERTYJO is not responsible for services offered by third parties.
- LIMITATION OF LIABILITY
ACERTYJO does not guarantee specific results regarding cognitive improvement, mental performance, learning, or personal development derived from use of the Platform.
Use of the Platform is recreational and educational in nature and is undertaken at the User’s sole responsibility.
ACERTYJO shall not be responsible for any economic expectations, financial decisions, commercial results, losses, damages, or consequences that the User may expect, assume, or experience as a result of participating in the Platform or the Referral Program.
In no event shall ACERTYJO be liable for indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use the Platform, even if advised of the possibility of such damages.
- REFERRAL PROGRAM
ACERTYJO may offer Users a Referral Program under specific conditions, which may be published separately and shall form an integral part of these Terms and Conditions.
The Referral Program does not constitute an investment, financial system, pyramid scheme, gambling activity, or employment relationship. Participation is voluntary and does not create guaranteed economic rights.
The availability of the Referral Program may vary depending on the applicable jurisdiction and current regulations.
Such program may include monetary compensation in real currency for effective referrals of the Platform, provided that the established conditions are met, including, among others, verification of referred memberships, absence of fraud or abuse, and compliance with ACERTYJO’s applicable policies.
Monetary compensation is not guaranteed, does not constitute salary or fixed income, and shall not be enforceable until it has been verified and approved in accordance with the current program conditions.
ACERTYJO reserves the right to modify, suspend, or terminate the Referral Program, as well as its percentages, levels, rules, and conditions, at any time and without prior notice, without creating vested rights, legitimate expectations, or future compensation.
- MEMBERSHIPS AND PAYMENTS
Certain features of the Platform require the purchase of an active membership for a defined period, which enables access to specific services and content while such period remains valid.
Payments made for the purchase of a membership are non-refundable, except as expressly provided in ACERTYJO’s Refund Policy.
Failure to purchase a new membership period may result in the suspension or loss of access to the Platform and its associated features.
Any monetary compensation in real currency that may arise from the Referral Program:
- is subject to verification, validation, and approval in accordance with the current program conditions;
- may be affected by refunds, chargebacks, fraud, system abuse, or breach of these Terms or any applicable policy;
- does not constitute an automatic or enforceable right until expressly approved by ACERTYJO.
ACERTYJO may establish minimum payout thresholds, payment methods, timelines, payout frequency in accordance with applicable policies, and verification procedures, as well as require the User’s compliance with tax obligations, in accordance with applicable law.
TAX RESPONSIBILITY
The User acknowledges and agrees that any monetary compensation in real currency received through the Referral Program may be subject to taxes, withholdings, reporting obligations, or other tax requirements under the laws of the User’s country, state, or jurisdiction of residence.
ACERTYJO does not provide tax, legal, or accounting advice and shall not be responsible for determining, withholding, reporting, or paying taxes on behalf of the User, except where expressly required by applicable law.
The User is solely responsible for complying with all tax obligations arising from payments received, including income reporting, payment of taxes, fees, or contributions, and providing accurate and up-to-date tax information when required by ACERTYJO or competent authorities.
ACERTYJO may require tax information, forms, or additional documentation as a condition for processing payments, in accordance with applicable law.
- PREVAILING LANGUAGE
These Terms and Conditions may be made available in one or more languages for informational or convenience purposes only.
In the event of any discrepancy, inconsistency, differing interpretation, or conflict between the English version and any translated version, the English version shall prevail at all times and shall be deemed the legally binding version.
- GOVERNING LAW AND JURISDICTION
This Agreement is governed by the laws of the State of California, United States of America.
Any disputes shall be submitted to the courts of the State of California.
