Privacy Policy

These ACERTYJO privacy policies (the “Privacy Policies”) take effect as of the moment Users accept the ACERTYJO Terms and Conditions (the “Terms and Conditions”). Capitalized terms not defined herein shall have the meaning ascribed to them in the Terms and Conditions.

This document forms an integral part of, and must be read jointly with, the Terms and Conditions prior to their acceptance. By accepting the Terms and Conditions at the time of registration, the User also accepts the Privacy Policies set forth herein.

ACERTYJO undertakes to maintain the confidentiality of the data entered on the Platform, in accordance with these Privacy Policies, which govern, among other matters, what information is collected, how it is stored, who has access to it, how long the data is retained, how data subjects may exercise their rights of access, update, rectification or deletion, and the applicable regulations.

  1. Collection of Data

ACERTYJO collects information directly and exclusively from Users when they decide to register on the Platform to access its services and become part of the ACERTYJO community.

For this collection, ACERTYJO uses online forms in which the following information is requested:

  1. a) Registered User: The User provides first and last name, contact telephone number, email address, and age.

In addition, ACERTYJO may collect technical information associated with the use of the Site, such as IP address, browser type, device used, operating system, date and time of access, as well as data related to interactions within the Platform.

  1. Method of Data Collection

ACERTYJO collects information primarily through the Site by means of online forms completed by Users and through data generated by the use of the Platform, such as participation statistics, feature usage, and game results.

ACERTYJO may also install cookies on a temporary or permanent basis for the operation of the Site, which do not directly contain sensitive personal data. Cookies are used to improve the User experience, remember preferences, and obtain statistical information.

The cookies used by ACERTYJO may be first-party or third-party cookies and may serve technical, functional, or analytical purposes, such as enabling the proper functioning of the Platform, remembering User preferences, analyzing Site usage, and improving the overall experience.

The use of cookies is not intended to personally identify the User or collect sensitive information. The User may manage, block, or delete cookies through their browser settings, taking into account that disabling certain cookies may affect the proper functioning of some Platform services.

  1. Storage of Collected Data

ACERTYJO, or third parties engaged by ACERTYJO, will store the Data collected on protected servers, applying reasonable technical and organizational security measures to prevent unauthorized access, loss, or alteration of the information.

Payments made on the Platform are processed by external providers such as Stripe and PayPal. ACERTYJO does not directly store complete credit or debit card details.

  1. Purpose of Data Use

The data collected is used to identify Users, manage accounts, provide the Services, send notifications related to the Platform, and improve the operation of the Site.

ACERTYJO may use technical and usage data for internal statistical purposes, performance analysis, fraud prevention, and continuous improvement of the service.

Likewise, ACERTYJO may disclose personal information when such disclosure is required by a competent judicial or regulatory authority, in compliance with applicable law.

  1. Authorization to Access Information. Duty of Confidentiality. Ownership of Content. ACERTYJO Control.

Personal data obtained through the Platform will be processed confidentially by ACERTYJO in accordance with these Privacy Policies.

Such information will not be disclosed to third parties without the User’s consent, except when:

  1. a) the information is publicly available;
    b) it is requested by a competent judicial or administrative authority;
    c) it is necessary for the provision of services (for example, technology providers, email services, web hosting, and payment processing via Stripe or PayPal);
    d) there is a legal or regulatory obligation requiring such disclosure.

In these cases, ACERTYJO will disclose only the information strictly necessary.

The User declares that all Content posted on the Platform is their property or that they have the necessary authorization to do so, and is solely responsible for such Content.

ACERTYJO is not responsible for the accuracy or legality of Content generated by Users.

The User acknowledges that ACERTYJO has the right, but not the obligation, to monitor, edit, block, or delete any Content that it considers, in its sole discretion, to be contrary to the law, these Terms and Conditions, or these Privacy Policies.

  1. Data Retention Period

The Data provided will be retained for as long as the User maintains an active account on the Platform.

Once the User cancels their account, the data will be deleted or anonymized, except for those that must be retained due to legal or tax obligations, or for legitimate security or fraud prevention reasons.

  1. Mechanisms for Rectification, Update, or Deletion of Data

The User may request access to, rectification, update, or deletion of their personal data by writing to:

ACERTYJO may request documentation to verify the identity of the requester before processing the request.

Privacy Rights (California – CCPA)

Users who reside in the State of California have additional rights under the California Consumer Privacy Act (CCPA), including, among others, the right to know what personal data is collected, the right to request deletion of personal data, and the right not to be discriminated against for exercising such rights.
ACERTYJO will not discriminate against any User for exercising their privacy rights and will process such requests in accordance with applicable law.

  1. Protection of Minors’ Data

The Platform is intended exclusively for individuals over 18 years of age. ACERTYJO does not knowingly collect data from minors.

  1. Sending of Emails

Users agree to receive informational, operational, and legal communications related to the Platform.

The User may request to unsubscribe from such communications through the links included in the emails or by writing directly to support@acertyjo.com.

ACERTYJO uses cookies and similar technologies to enable the proper operation of the Platform, improve the User experience, maintain active sessions, analyze site usage, and ensure service security.

Cookies are small data files stored on the User’s device when accessing the Platform. These cookies may be first-party cookies used by ACERTYJO or third-party cookies used by service providers necessary for the operation of the Platform, such as analytics, authentication, payment, or security providers.

The User may configure their browser to reject or delete cookies. However, disabling cookies may affect the proper functioning of the Platform and limit access to certain features or services.

  1. Prevailing Language

In the event of any discrepancy, inconsistency, differing interpretation, or conflict between the Spanish version of this Privacy Policy and any translated version, the English version shall prevail and shall be deemed the legally binding version.
